Direct Debit Request Terms and Conditions

These Terms and Conditions and the Direct Debit Request comprise the Agreement between You and Us.


1) Debiting Your Account

(a) By providing a Direct Debit Request You have authorised Us to arrange for funds to be debited from Your Account.

(b) We will debit Your Account as authorised in the Direct Debit Request.

(c) If the Payment Day falls on a day that is not a Business Day, We may direct Your Financial Institution to debit Your Account on the following Business Day.


2) Amendments

(a) You may change, stop or defer a Payment, or terminate the Agreement by providing
Us with at least 14 days written notice to Us prior to the next Payment Date to:

(i) info@kidswish.org.au

(ii) by telephoning Us on 1300 347 224

(iii) by arranging directly with Your Financial Institution.


3) Your Obligations

(a) You must ensure that there are sufficient clear funds available in your Account to allow a Payment to be made in accordance with the Direct Debit Request.

(b) If there are insufficient clear funds in your Account:

(i) You may be charged a fee and/or interest by your Financial Institution;

(ii) You may also incur fees or charges imposed or incurred by Us; and

(iii) You must arrange for the Payment to be made by another method or arrange for sufficient clear funds to be in your Account by an agreed time so that We can process the Payment

(c) You should check:

(i) Your Account statements to verify that the amounts debited from your Account are correct;

(ii) whether your Financial Institution allows for direct debits; and

(iii) that the details of your Account are correct.


4) Disputes

(a) If you believe there has been an error in debiting your Account, You should contact Us
promptly at info@kidswish.org.au or by telephoning Us on 1300 347 244, in addition to contacting Your Financial Institution.

(b) We will notify You of the outcome of any investigations in relation to Your Account and
will provide reasons for and any evidence in relation to particular findings.

(c) If We concludes that your Account was incorrectly debited, We will arrange for Your Financial Institution to adjust your Account and You will be notified in writing.


5) Confidentiality and Privacy Policy

(a) We will keep any information (including Your Account details) provided in Your Direct Debit Request confidential. We will only disclose information provided by You:

(i) to the extent required by law; or

(ii) to facilitate the purposes of the Agreement.


6) Notice

(a) If You wish to notify Us of anything in relation to this Agreement, please send to info@kidswish.org.au or 5 Edney Lane, Spring Hill, 2500.

(b) We can send You notices to the email address that you have nominated or by post to the
address that You have provided.

(c) If sent by post, the notice will be taken to have been received on the fourth Business Day after posting.


7) General

(a) These Terms and Conditions and the Direct Debit Request contains the entire Agreement
as to its subject matter and may only be varied in writing.

(b) The Agreement is governed by the law of NSW.


8) Definitions

Unless otherwise indicated these terms mean:

(a) Agreement means these Terms and Conditions and the Direct Debit Request.

(b) Account means the account nominated by You in the Direct Debit Request held at Your

Financial Institution from which we are authorised to arrange for funds to be debited.

(c) Business Day means any day except a Saturday, Sunday or public holiday in New South Wales.

(d) Direct Debit Request means the Direct Debit Request between Us and filled out by You.

(e) Financial Institution means the financial institution nominated by You in the Direct Debit

Request where You hold the Account that You have authorised Us to arrange to debit.

(f) Payment means the amount nominated by You in the Direct Debit Request.

(g) Payment Day means the day nominated by You in the Direct Debit Request on which
You have authorised Us to arrange to debit.

(h) Us means Kidswish Limited (ACN 649 591 239) of 41 Willinga Road, Flinders NSW.

(i) You means the individual or company who completed and signed the Direct Debit Request.)
